Can NRIs buy property in Mumbai?

Yes. NRIs (Non-Resident Indians) and OCIs (Overseas Citizens of India) can legally buy residential and commercial property in Mumbai without prior approval from the Reserve Bank of India (RBI). The purchase is governed by FEMA — the Foreign Exchange Management Act — which allows NRIs to buy flats, apartments, and commercial units freely.

What NRIs cannot buy: agricultural land, plantation property, or farmhouses. All other residential property — including under-construction and ready-to-move flats — is permitted.
